Donald Trump failed to persuade a federal judge to postpone a Nov. 28 trial in which he’ll face former enrollees in his real-estate seminars who claim they were cheated.

U.S. District Judge Gonzalo Curiel in San Diego on Thursday rejected the request by the Republican presidential candidate’s lead lawyer to put off the trial until January. Trump’s lawyer, Dan Petrocelli, had asked for the delay because he has another case going to trial less than two weeks before the Trump University dispute and argued he wouldn’t be able to prepare adequately.

“Defense counsel had multiple opportunities to raise the issue with the court prior to Aug. 26, 2016, but did not do so,” the judge said.

Christine Beswick reports that Trump has “at least three open class action cases of racketeering and fraud, divided between California and New York, and multiple open cases in other states such as Florida, Idaho, and Texas.” One of those cases is The Cohen (Nationwide) Action, Cohen v Trump, wherein the complaint states the Nature of the Action as follows: “Defendant ensnared Plaintiff and thousands of other student-victims in a fraudulent scheme nationwide to sell real estate seminars and mentorships (“Live Events”) by trading on the Trump moniker.”

Additionally, Trump has a Racketeer Influenced and Corrupt Organizations Act (RICO) case open and active in the Fifth Circuit U.S. Court of Appeals. Those are serious complaints and University of Utah Law Professor Christopher Peterson argues that there is ample evidence to impeach Trump should he be elected.

I’m afraid that’s an old article, discussing Judge Curiel’s denial of the previous request for a continuance. Note that it says the denial occurred Thursday? If this were about the current request, that would be last Thursday, which is before Trump’s lawyers even requested the continuance.

I think the point being made is that, as we do not yet have a judgement in the most recent attempt to get the trial postponed, it is still set for November 28. That will remain true unless a) they settle or b) the most recent request for a postponement – filed on Saturday evening, November 12 – is successful 3) the parties reach a settlement.

One of the reasons given for the new request for delay by Trump’s lawyers that extra time would give both sides time to videotape Donald Trump’s testimony or possibly reach a settlement.

      We’ll see.
