Jennifer A. Borg, vice president, corporate secretary and general counsel for North Jersey Media Group, said the lawsuit was filed when neither Palin nor the PAC responded to a letter.
“It is important to enforce our copyright on this iconic photo,” Borg said. “When neither Ms. Palin nor representatives from her PAC responded to our demand letter to remove the photograph, we were left with no choice but to seek redress in court.”
The lawsuit asks the court to stop SarahPAC from using the picture. It also seeks damages.
Arlington, Virginia-based SarahPAC did not respond to a message for comment. The image appeared to have been removed from its position on both the Facebook page and the PAC website as of early afternoon today.

Update: Meanwhile, over at the pond, the poor dullards are still in denial. A very limited number of them can actually see what the problem is with the use of this photo, but the rest of them are enraged and are refusing to see what to everyone else is so clear.
I was really sick of listening to their bullshit, so I left a comment. It went into moderation… I told them they were being deliberately obtuse and the function of a PAC is to raise money, so if Palin is plastering her PAC logo on these pics, then of course she is advertising and trying to raise money. Of course the comment never made it past moderation. Those silly feckers live in their own insulated little bubble. I went back a few minutes ago and took another screenshot of their conversation…
Of course they have it arseways. The paper didn’t run to the court first. Palin and her PAC ignored their request and only then were they left with no choice but to take it to court. Oops, one poster has discovered that and posted the same link as I have above – she has no likes.
They really can’t justify why she was exploiting the tragedy of 9/11, but they are trying damn hard.
